Article 2 – PRODUCTS
The products and services offered are those which appear on the LA ROCHÈRE commercial site https://www.larochere.com/boutique . This range does not include all the products referenced in the company's catalogs.
The product offers presented by LA ROCHÈRE online are offered, while stocks last.
The LA ROCHÈRE company reserves the right to modify the product assortment at any time.
Each product is accompanied by a description drawn up by LA ROCHÈRE listing the main technical characteristics.
The contractual information is presented in French and in English, with the French version being authentic in the event of a contradiction. The contractual information will be confirmed at the latest at the time of delivery.
The photographs of the products are as faithful as possible but cannot ensure perfect similarity with the products sold.

Article 4 – PRICES
The prices appearing on the LA ROCHÈRE merchant site are inclusive of VAT in euros, taking into account the VAT applicable on the day of the order, excluding shipping costs. Any change in the rate may be reflected in the price of the products or services.
LA ROCHÈRE reserves the right to modify its prices at any time, it being understood, however, that the price appearing on the merchant site on the day of the order will be the only one applicable to THE CUSTOMER.
The prices indicated do not include order processing, transport and delivery costs as long as they take place in the geographical areas provided below, which are invoiced in addition and brought to the attention of THE CUSTOMER before validation. of his order.
The telecommunications costs inherent in access to the site remain the exclusive responsibility of the Internet user.
Article 5 – ORDER AND AVAILABILITY
THE CUSTOMER declares and guarantees having the legal capacity to contract or commit.

LA ROCHÈRE will communicate by email confirmation of the registered order.
If the product is not available, LA ROCHÈRE undertakes to inform THE CUSTOMER by e-mail. In accordance with article L. 121-11 of the Consumer Code, THE CUSTOMER will then have the possibility of requesting the cancellation of their order or its partial delivery.
LA ROCHÈRE reserves the right to refuse or cancel any order from a buyer if it is abnormal, placed in bad faith or for any other reason, and in particular when there is a dispute relating to the payment of a previous order .
Article 6 - PAYMENT
The price is due when ordering.
Payments will be made by credit card or transfer or by Paypal or by check.

Article 7 – DELIVERY
Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area.
THE CUSTOMER is solely responsible for a delivery failure due to an error or lack of information when ordering.
Cases of force majeure or any other situation beyond the control of LA ROCHÈRE may delay or suspend the execution of an order.
Orders are delivered by La Poste via COLISSIMO according to the delivery method chosen by THE CUSTOMER, delivery service with tracking, delivery against signature. An e-mail will be sent to THE CUSTOMER informing them that their package has been shipped, as well as the link for tracking.
RECEPTION
THE CUSTOMER is required to check the condition of the packaging of the goods and its contents when he takes physical possession of his goods. DELIVERY DELAY
The maximum delivery time is 30 days from the order, unless specifically indicated to THE CUSTOMER before placing the order. After these deadlines, the sales contract may be terminated and THE CUSTOMER reimbursed.
Delivery times are given for information purposes only. They run from confirmation of the order by LA ROCHÈRE.
Delivery times depend on the delivery method chosen by THE CUSTOMER. For COLISSIMO delivery to your home or to a relay point, delivery times are between 5 and 7 working days for France, and export: between 5 and 15 working days. These deadlines do not take into account order preparation and exclude Saturdays, Sundays and public holidays.
The above deadlines exclude postal delivery problems, depending on product availability and excluding factory closure periods.
THE CUSTOMER has the right to cancel his order if delivery has not occurred within 14 working days after the delivery date indicated by LA ROCHÈRE.
THE CUSTOMER will be reimbursed no later than 30 days after payment of the sums he has paid.
Article 8 - WITHDRAWAL, RETURNS, EXCHANGES, REFUNDS
Under article 221-18 of the Consumer Code, THE CUSTOMER has a period of fourteen days from delivery of the order to exercise their right of withdrawal and return the product to LA ROCHÈRE for exchange or reimbursement without penalty, and without having to provide reasons.

Otherwise, it is essential that LA ROCHÈRE can identify the order and THE CUSTOMER who returns the product in order to reimburse it under the best conditions. THE CUSTOMER is invited to attach to the returned product the documents allowing it to be identified as well as the references of his order (copy of the delivery note, invoice, order, etc.) and the nature of his request (reimbursement, exchange with references of new products).
The products must be returned in their original packaging protected by outer packaging, in perfect condition allowing their resale, accompanied by the original labeling.
Incomplete, damaged, damaged or soiled products will not be returned or exchanged. Products which appear to have been subject to prolonged use making their resale impossible will be refused.
Returned items will be refunded according to the payment method used by THE CUSTOMER when ordering online, within 14 days of receipt of the goods, in accordance with article L.221-24 of the Consumer Code.

Article 9 - GUARANTEE AND COMPLIANCE
All products on sale on the site benefit from the guarantee against hidden defects provided for by articles 1641 et seq. of the Civil Code, valid for 24 months after the discovery of the hidden defect, and from the legal guarantee of conformity provided for in articles L. 217-4 et seq. of the Consumer Code, valid for 24 months from delivery of the product.

Article 10 – ARCHIVING AND EVIDENCE
LA ROCHÈRE will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
LA ROCHÈRE's computerized records will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
Article 11 – RESPONSIBILITY
